Worst Floors in the Delware Valley Sweepstakes Rules
1. No purchase is necessary to participate in this promotion, and you do not have to participate in a sales presentation. Void where prohibited by law, rule or regulation. You may enter this promotion by completing the entry form on-line on the Floors USA contest page at www.floorsusa.com. No more than one entry per household is allowed. All contest entries will become the property of Floors USA and will not be acknowledged or returned.
2. Floors USA will award one (1) winner as selected by a Floors USA representative. The contest period begins on March 3, 2010 and ends on March 31, 2010. All entries must be received by Floors USA by 11:59pm on March 31st to be eligible. The prize winner will be selected by a Floors USA representative in his or her sole discretion based on his/her determination of the most deserving contest entry. The decision will be made within five business days after the end of the contest period. Floors USA reserves the right at its sole discretion to suspend modify or terminate this promotion without notice at any time. The winner will be notified by certified mail within 15 days of the decision. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. All prizes will be awarded.
3. “Worst Floors in the Delaware Valley” nominees must (i) be legal residents of New Jersey, Pennsylvania, or Delaware (ii) be 18 years of age or older, (iii) own their own home, which home has a structure that is in a suitable condition (as determined by Floors USA or its designees) for installation of the prize (including compliance with local building codes and regulations), and (iv) reside in a geographic area in which Floors USA is permitted to install such prize at the winner's location. Employees, officers and directors (and their immediate family members and those living in the same household) of Floors USA, Greater Media Philadelphia, and their respective affiliates, subsidiaries, co-branded partners, consultants, contractors, advertising, public relations, promotion, fulfillment and marketing agencies, are not eligible to participate in the promotion.
4. The winner will receive a $1000 gift certificate (retail value) for the purchase of Floors USA products, and FREE standard professional installation of the purchased products by Floors USA or its designees in one room not exceeding 12’ x 20’. Any costs in excess of retail value of the prize certificate (including, without limitation, sales tax) shall be the sole and exclusive responsibility of the winner. If winner’s total purchase is less than the certificate value, no cash refund or other compensation will be provided. Prizes are not transferable by the winner. Installation must be provided by Floors USA personnel or Floors USA designee. Prize subject to availability and may be subject to black-out dates. Scheduling of installation is subject to availability and limited to NJ, PA and DE. Installation subject to the terms and conditions of Floors USA standard installation guidelines; any additional work and expenses are the sole responsibility of the winner.. All expenses not specifically provided for herein are the sole responsibility of the winner. Notwithstanding anything to the contrary in these Rules, if the winner has already purchased goods or services from Floors USA, the winner may not apply winnings to previous purchases.
5. Winner’s home must be in suitable condition for product installation (e.g., no water, mold, structural damage, etc.). Any waterproofing, remediation or other repairs necessary for proper installation (as determined by Floors USA or its designees in their sole discretion) must be performed at owner's expense prior to installation of the products. Installation labor does not include painting, staining, lighting or HVAC systems. No transfers, substitution in prizes or cash will be allowed except by Floors USA, who may substitute a prize with a value of at least $1000. Upon installation of prize, Floors USA will be deemed to have awarded the prize to the winner with the winner assuming full ownership and responsibility for the prize. Winner must arrange for prize installation no later than one month following the award of the prize and installation must occur and be completed within six months of confirmed notification.
6. The winner must comply with all instructions in the prize notification correspondence, which may include the completion of an affidavit of eligibility and liability/publicity release, as well as have met all of the eligibility requirements set forth within these Rules; otherwise prize will be forfeited and an alternate winner will be selected. Acceptance or use of a prize constitutes permission for Floors USA, Greater Media Philadelphia, and their respective affiliates to use recipient’s name and likeness for advertising and promotional purposes without compensation, unless otherwise prohibited by law.
7. Liability for any applicable taxes, including all federal, state, and local taxes and/or other fees that may apply to prizes are the sole responsibility of the winner. Any required tax reporting forms will be furnished to the Internal Revenue Service. All expenses not specifically provided for by Floors USA in these Rules are the sole responsibility of the winner.
8. Entries that are lost, late, illegible or incomplete for any reason will not be eligible. Floors USA reserves the right to modify or terminate this Contest at any time or disqualify any entry in good faith. In the event of a dispute concerning the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the winning home is titled.
9. For winner's list, mail a self-addressed, stamped envelope within 30 days following the end of the prize period to Floors USA, 555 Henderson Road, King of Prussia, PA 19406, including a request for the winner’s name. Floors USA maintains a notification system that you can use to stop any Floors USA or contest-related mailings from being sent to you. If you wish to place yourself on this notification system, just write to Floors USA at the foregoing address with your request, and provide your name and address.
10. By participating in the promotion, participants agree to release, discharge and hold harmless Floors USA, Greater Philadelphia Radio, Inc., their respective affiliates, co-branded partners, subsidiaries, retailers, advertising and promotional partners, agencies and the officers, directors, employees and agents of those entities, from any injuries, loss, or damages of any kind which may arise out of participation in the promotion in any way or out of the acceptance, use, misuse or possession of a prize. Acceptance of a prize may require entering a standard contract or purchase order for the goods and services to be provided, as required by state law. This promotion is conducted in English (which will be given its everyday ordinary meaning). This Contest is sponsored by Floors USA, 555 Henderson Road, King of Prussia, PA 19406 and governed by the laws of the United States with venue in Brookhaven, Pennsylvania.
11. Neither Floors USA nor Greater Media Philadelphia is responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this promotion, or by any human error which may occur in the execution of this promotion. If, for any reason, the promotion is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of Floors USA, Floors USA reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s). Greater Media Philadelphia undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of the prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the promotion, including (but not limited to) cancellations, postponements, delays or other scheduling changes; and accident, injury, death, damage or expense arising from or occurring during the use of the prize by the winner and/or winner’s guest(s).
12. By participating in this promotion, participants agree to be bound by these rules and all decisions of the judges, who are employees of Floors USA and whose decisions with respect to all aspects of the promotion and the award of the prize are final and binding.
